Samsung Galaxy 10.1 Back on the Market

Samsung received some good news on Monday, Oct. 1 when the same judge who put a temporary sales ban on its Galaxy Tab 10.1 tablet for a patent violation lifted the injunction.

The ban was nixed by U.S. District Judge Lucy Koh following a Sept. 28 ruling in the U.S. Court of Appeals that Samsung could seek an end to the injunction, since it did not violate the patent in question.

"We are pleased with the court's action today, which vindicates our position that there was no infringement of Apple's design patent and that an injunction was not called for," Samsung said in a statement published by Reuters.

Koh originally issued the ban in June after determining that the company had most likely copied features of Apple mobile devices, including the iPad tablet. Apple eventually won the case in August, emerging from the dispute with over $1 billion in damages.

The end of the sales ban comes before Koh acts on post-trial motions, which does not sit well with Apple. The Wall Street Journal indicates that the company had requested that Koh wait to remove the injunction until after acting on the companies’ post-trial motions. Apple looks to receive more money in damages and a permanent ban on the Galaxy Tab 10.1 and similar devices during that period.

Meanwhile, Samsung ultimately wants all financial penalties and sales bans of its products removed, but the company is not yet in the clear. The device in question could still be subject to sales bans if its other patent infringements are upheld.

Koh is expected to act on post-trial motions in December.
